Subdivision Ordinance

 
 
The Transylvania County Commissioners amended the regulations to the Subdivision Control Ordinance on Monday, August 27, 2012.   If you plan to divide property you must adhere to the regulations in this ordinance.  Plats shall be clearly and legibly drawn at a scale of not less than two hundred feet (200') to one inch (1") and shall be drawn on a sheet size of 18"x24" mylar acceptable to the Register of Deeds of Transylvania County.

Subdivision Ordinance Checklist.  All items listed on the checklist must be on the preliminary and final plats.

Erosion/Sediment Control Permit Application.  Download the document, fill it out and fax or mail to the above fax number or address.

Family Subdivision - Statement of Understanding Form.  This form is required to be submitted with all Family Subdivision plats.

                                                                                                                                                                                                              

Fees cover plat review for preliminary and final plats and all road inspections.  If more than 2 road inspections are required for the same subdivision, a $75 fee will be charged per additional inspection.

(1) Reductions in the road right-of-way width may be permitted in unified residential developments to no less than thirty feet (30') upon approval by the Planning Board.  Reductions allowed shall be based on community character, sound engineering principles and public safety considerations.

(2) Reductions in the turn radius may be permitted in unified residential developments upon approval by the Planning Board.  Reductions allowed shall be based on community character, sound engineering principles and public safety considerations.
